This Site is offered and made available only to users 13 years of age or older who reside in the United States of America.

Member Content is the sole responsibility of the person from which such Member Content originated (see Terms of Use Agreement

Log File Information: When you use the X2theL service, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, content play information, and one or more cookies that may uniquely identify your browser.

HOW INFORMATION WE COLLECT IS USED

As a registered user, you acknowledge, understand and hereby agree that you are giving us your consent to track your activities and your use of the Site and its functions and features, in connection with your registration. Member Content is the sole responsibility of the person from which such Member Content originated. This means that you, and not X2theL, are entirely responsible for all Member Content that you upload, post, email, transmit or otherwise make available through the Site or Service. To the extent that X2theL provides you with an opportunity to post, store and exchange Member Content, you agree to and hereby do grant, and you represent and warrant that you have the right to grant, X2theL, its contractors, and the users of the X2theL Site an irrevocable, perpetual, non-exclusive, royalty-free, fully sublicensable, fully paid up, worldwide license to use, copy, publicly perform, digitally perform, publicly display, and distribute such content and to prepare derivative works of, or incorporate into other works, such Member Content on the X2theL Site or Service. This license does not grant X2theL the right to sell Member Content or sublicense through or otherwise distribute it outside of X2theL's Site or Service; provided, however that streaming of content on third party web sites via embedded widgets shall not be deemed a distribution outside of X2theL’s Site or Service.

3. Dealing With Advertisers

Occasionally, you may communicate with, receive communications from, be re-directed to, interact with, or participate in or use the services or obtain goods and services of or from third parties (collectively, the "Advertisers") such as our advertisers, sponsors, or promotional partners as a result of your use of the Site. All such communication, interaction and participation is strictly and solely between you and such Advertisers and we shall not be responsible or liable to you in any way in connection with these activities or transactions (including, without limitation, any representations, warranties, covenants, contracts or other terms or conditions that may exist between you and the Advertiser or any goods or services you may purchase or obtain from any Advertiser).

DISCLOSURE OF CERTAIN INFORMATION

X2theL may disclose certain user Personal Information with affiliates or non-affiliated parties for the following limited circumstances: 1. We disclose that a certain partner(s) may contact you regarding certain offers; 2. We will ask for your consent to opt-in or opt-out of specific promotions or features; 3. We are compelled to do so by a governmental agency, court or other entity (e.g., to respond to subpoenas, court orders or legal process); 4. If we believe your actions violate any law, regulation, our Terms of Use Agreement, this Privacy Policy, or any of our guidelines for promotions, Product offerings or any other features or functions of the Site, or if you threaten the rights, property or safety of the Site, X2theL, its operational service providers, suppliers, Advertisers, other customers or users, or any other party; 5. If, in our sole discretion, we believe such disclosure to be necessary or appropriate to investigate or resolve possible problems or inquiries, to protect our business and assets, to defend our interests and/or to comply with our legal and regulatory obligations; or 6. In the event of a bankruptcy, merger, acquisition, transfer of control, joint venture or other business combination involving X2theL LLC or other subsidiaries. You retain the right to control to remove or alter your account specific information at any time.

SHARING YOUR INFORMATION WITH THIRDAY PARTIES/ ADVERTISERS ETC

We do not sell, rent, lease or disclose your Personal Information to unaffiliated entities or entities that are not our Advertisers, except in the limited circumstances listed below. When may disclose your Personal Information to Advertisers; however, we allow you the opportunity to ("Opt Out") from such sharing , in which case your information will not be shared. When your information is shared, it is subject to the Advertiser's own privacy policy. The Site also offers co-branded services and features, which are events and promotions (for example, a contest or a concert) that we put together with another company ("Co-Branded Partner"). We will share your Personal Information with our Co-Branded Partner and your voluntary use and/or participation in a co-branded service or feature means that you have given your affirmative consent to both the X2theL service and our Co-Branded Partner to collect and use your Personal Information. If you wish to Opt-Out of a Co-Branded Partner's future use of your Personal Information, you will need to contact the Co-Branded Partner directly.
